This disclaimer ("Disclaimer") sets forth the general guidelines, disclosures, and terms of your use of the survivalapnea.com website ("Website" or "Service") and any of its related products and services (collectively, "Services"). This Disclaimer is a legally binding agreement between you ("User", "you" or "your") and Survival Apnea LLC ("Survival Apnea LLC", "we", "us" or "our"). By accessing and using the Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Disclaimer. If you are entering into this Disclaimer on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Disclaimer, in which case the terms "User", "you" or "your" shall refer to such entity. You acknowledge that this Disclaimer is a contract between you and Survival Apnea LLC, even though it is electronic and is not physically signed by you, and it governs your use of the Services.

 

1. Participation Requirements

Participants affirm that they are of the legal age of majority in the jurisdiction in which they reside (at least 18 years of age in many countries), and, if applicable, you are willingly using the Services and entering into this Disclaimer on behalf of your child or ward, who is between the ages of [Insert age range], to participate in breathing and apnea training.

 

2. Health and Safety Acknowledgment

You acknowledge that all exercises, including breathing and apnea training, involve a risk of personal injury, including a small risk of serious injury or death, and agree that you voluntarily participate in these activities and use our Services with knowledge of the danger involved. You hereby agree to accept any and all risks of injury or death

 

3. Fitness and Health Warranty

You warrant that you are physically fit and have no medical condition or history that would prevent your participation in these activities. You should consult with a healthcare professional before beginning any new exercise program, including our breathing and apnea training. Survival Apnea LLC is not a licensed medical care provider and represents that it has no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise on a medical condition.

 

4. Release of Liability

You hereby agree to release Survival Apnea LLC, its officers, employees, agents, representatives, and any affiliated partner companies around the world from any claims, demands, and causes of action as a result of your voluntary participation and enrollment in the classes, courses, and activities (the "Programs") provided by Survival Apnea LLC.

 

 5. Indemnification

You agree to indemnify and hold Survival Apnea LLC and its partners, subsidiaries, affiliates, officers, agents, employees, representatives, successors, and assigns harmless from any loss, liability, damage, or costs, including court costs and attorney’s fees, that they or any of them may incur as a result of or arising from your participation in the Programs.

 

6. Acknowledgment of Understanding

You have read this Disclaimer and fully understand its terms. You understand that you are giving up substantial rights, including the right to sue. You further acknowledge that you are signing the disclaimer freely and voluntarily, and intend by your participation to be a complete and unconditional release of all liability to the greatest extent allowed by law.
